Agora - Candidate's Privacy Notice

This privacy notice (the “Privacy Notice”) describes how we collect and use Personal Data about candidates in the process of the candidate’s application for employment, in accordance with the Protection of Privacy Law, 5741 – 1981 (“Israeli Law“) and the EU General Data Protection Regulation (the “GDPR”) as well as other European or local legislation and other relevant applicable privacy laws, for example in the United States. Please note that any reference in this notice to “Agora”, “we”, “us”, “our” refers to Agora and its affiliated companies. Agora will be the “data controller” of candidates’ Personal Data.

Important note: Nothing in this privacy notice is intended to limit in any way your statutory right, including your rights to a remedy or means of enforcement. 

Personal Data” refers to any information that relates, alone or together with other data, to a uniquely identify or identifiable individual, as set for in applicable privacy laws. You are not obligated to provide us with Personal Data, and to the maximum extent permitted by law, by submitting your application, you hereby confirm that providing us with Personal Data is of your own free will and consent. The terms of this Privacy Notice detail our collection, processing, and sharing practices of Personal Data. If you do not agree to this Privacy Notice, please do not apply for the relevant position.

We will process information about the candidates, including the information appears in their CV, such as personal contact details, name, title, addresses, telephone numbers, work and personal email addresses and other information included in a CVs and/or cover letters or as part of the application process (including their education details, and training details, former employment records including job titles, work history, and professional memberships), job interviews summaries and salary/compensation offers and other similar information as needed to consider their application and as permissible under local law. In certain jurisdictions and subject to applicable law, we verify that candidates are not listed in criminal wanted lists or similar registers. If the applicant receives and accepts an offer of employment with Agora, the applicant will have to provide proof of the applicant’s identity and, in some countries, proof of the right to work; failure to provide this will mean that Agora is unable to hire the applicant. Either Agora or an independent agent acting on behalf of Agora, may verify the information provided by applicants and (to the extent permissible by local law) carry out further enquiries which may include a background check, reference check, a media search (which may include publicly accessible social media and search engine searches) and a satisfactory medical examination (in each case only if legally required and permissible). If the applicant fails to supply Personal Data which Agora lawfully requires to satisfy these checks Agora may be unable to employ the applicant. 

Agora needs to collect and process your Personal Data for the purposes of:

  • receiving, reviewing and replying to your application;
  • verifying the information you or others provide, and checking your references;
  • assessing your suitability for the opportunity you applied for;
  • facilitating interview/recruiting process;
  • staying in touch and engaging with you for opportunities at Agora we may consider you for current and future opportunities.

If you are an individual in the EU or your data is treated under GDPR regulations, Agora’s legal basis for collecting and processing your Personal Data (if applicable) is as follows:

  • Contractual Necessity. Certain processing activities are necessary for the performance of our recruitment process between you and Agora. For example, processing your CV is essential for us to review your candidacy and consider your application for the position. Processing is also necessary for the performance of a contract to which you, as the data subject, are party or to take steps at your request prior to entering into a contract, such as assessing your suitability for the vacancy and making hiring decisions.
  • Legitimate Interests. We engage in certain data processing activities driven by our genuine interests, always with due consideration for safeguarding your privacy. These activities encompass evaluating your candidacy for the position and similar positions, identifying potential fitting roles, and supporting efficient HR management and recruitment processes. This approach aids in aligning talents with opportunities while ensuring adherence to our organizational goals and ethical standards. In addition, we process Personal Data for the purposes of the legitimate interests pursued by Agora, in particular its economic, commercial and financial interests, business continuity, security and confidentiality of customer information and products, security of digital and physical infrastructure.
  • Consent. When we process your Personal Data based on your explicit consent, you have the right to withdraw it at any time. Please note that, in some cases, withdrawing consent may impact our ability to process your application.
  • Legal Obligations. We may process your Personal Data for compliance with legal obligations to which Agora as a controller is subject to.

Any offer and commencement of employment is conditional on the verification, to the satisfaction of Agora, of the information the candidate provides as part of their application (to the extent permissible by local law) and on Agora being able to obtain references with which it is satisfied. 

The information above will be handled in accordance with Agora’s Data Protection Policy, and to the extent legally permissible, your information may be shared with Agora’s affiliated companies for the purposes specified above. Agora will ensure that equivalent data protection laws apply to transfers outside of your country or that there are suitable safeguards in place in respect of the privacy of their data such as via Agora’s intercompany transfer agreement and Standard Contractual Clauses. Agora may share their information with third parties if it is under a duty to disclose or in order to comply with any legal obligation or to protect its legitimate rights, property, or safety of its employees, candidates, customers, or others (assuming there is no reason that the data should not be shared).

If the candidate is successful in obtaining employment at Agora, the information which Agora needs to keep in order to make further arrangements for their employment will be retained whilst their employment continues and as set out in Agora’s Data Retention Policy.

In connection with Agora’s processing of their Personal Data and under certain circumstances specified by law, candidates have rights to:

  • ask to review their Personal Data;
  • ask for erasure or rectification of inaccurate Personal Data and to have any incomplete data completed;
  • ask for erasure of Personal Data (i) that was created, received or its use is in violation of any law or (ii) that is no longer necessary for the purposes for which it was created, received or collected;

In addition, candidates in certain jurisdictions, for example in the EU have additional rights, including: 

  • ask for erasure of Personal Data;
  • ask for restriction of processing;
  • object to processing;
  • obtain confirmation as to whether or not their Personal Data is being processed by Agora and where that is the case, access their Personal Data and information regarding the processing of that data; 
  • request that Agora transfer their information to another party; and
  • not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning the candidate or similarly significantly affects them. 

Also, please note that there are other exceptions to these rights, and they may be limited in some situations, and in any event case, we will exercise such right in accordance with applicable law.

If the candidate is not successful, any personal documents that they have submitted to Agora, or the background check vendor (when applicable) may be retained for the purpose of staying in touch regarding future job opportunities. If a candidate prefers that their data not be kept for this purpose, they can indicate so via email, and we will ensure it is promptly deleted in accordance with Agora’s Data Protection Policy.
